Understanding Oregon Divorce
Divorce affects every aspect of your life. It can make life seem out of control, even if it is planned. Most people who go through divorce are doing so for the first time, and the process can be intimidating. In fact, those who are going through divorce for a second time often tell us that wish they had used an attorney rather than try to figure out the process alone. We believe in empowering you not only by listening to you and making sure you are heard, but by informing you about the legal process so you will know what to expect.
Grounds for Divorce
Oregon is a no fault state. This means that you do not need a reason (i.e., adultery, abandonment, etc.) to obtain a divorce. You only must state “irreconcilable differences” exist between you and your spouse for the court to grant your divorce. This is not to say that “bad acts” don’t matter. However, while “bad acts” may play a factor in other aspects of your divorce (i.e., support, custody, property divisions, etc.), they are not necessary to begin the process.
To file for divorce in Oregon, either you or your spouse must have lived in Oregon for at least 6 months. The divorce may be filed in a county where either of you reside. If you have lived in Oregon for less than 6 months, please contact our office to discuss other options, such as legal separation in anticipation of divorce.
